Waiver / liability release

WAIVER AND RELEASE OF LIABILITY, MEDICAL RELEASE, AND PHOTO/VIDEO RELEASE

For purposes of this Agreement: "Martial Arts Activities" means all classes, competitions, seminars, rank testing's, practices, demonstrations, workshops, travel, or any other martial-arts-related activity hosted, offered, provided, or sanctioned by the Released Parties.

"Released Parties" means Energy Martial Arts Oklahoma LLC, doing business as ATA Energy Martial Arts, the American Taekwondo Association, Inc. (d/b/a ATA International), Redline Athletics and all associated owners, officers, directors, employees, volunteers, agents, and assigns.

WAIVER AND RELEASE OF LIABILITY

I understand the inherent risks involved in martial arts activities, including physical injury, disability, death, or property damage. I voluntarily assume all risks. To the fullest extent permitted by Oklahoma law, I waive and release the Released Parties from liability arising from participation, including ordinary negligence, but excluding gross negligence or willful misconduct.

MEDICAL RELEASE:

I authorize emergency medical care if necessary and agree to be financially responsible for all associated costs.

PHOTO/VIDEO RELEASE

I grant permission for photographs and video recordings to be used for lawful promotional or instructional purposes without compensation.

DURATION OF AGREEMENT:

This Agreement applies for the entire term of the Student's enrollment and shall continue to apply thereafter, to the fullest extent permitted by Oklahoma law.

ACKNOWLEDGMENT:

I acknowledge that I have read and understand this waiver and sign it voluntarily.

Energy Martial Arts IS AN INDEPENDENTLY OWNED AND OPERATED FACILITY.

ATA HEADQUARTERS HAS NO CONTROL OVER THIS DOCUMENT/AGREEMENT

The undersigned, for himself/herself, and/or on behalf of member acknowledges that he/she understands the risk of injury inherent in any vigorous physical activity and assumes such risk. The undersigned certifies that he/she has been urged to consult a physician about any special condition which would make member unusually susceptible to injury and immediately advise Energy Martial Arts of any such condition in writing, . All students' training equipment must be Energy Martial Arts and ATA approved for insurance liability purposes.

The undersigned certifies that he/she knows of no physical condition which would make the member unusually susceptible to physical injury. The undersigned for himself/herself, and/or on behalf of member hereby waives any claims against , its' officers, directors, instructors or agents arising directly or indirectly from any injury suffered by member at Energy Martial Arts, its facility (Redline Athletics) or during any Energy Martial Arts sponsored event, other than injuries resulting from the willful misconduct of Energy Martial Arts officers, directors, instructors or agents.

The undersigned certifies that he/she has explained to the member, in terms that member can understand, the vital importance of following the rules established for members by Energy Martial Arts and agrees to indemnify and save harmless Energy Martial Arts, Redline Athletics, ATA International, its' officers, directors, instructors and agents from any loss, liability, suit or claim arising directly or indirectly from member failing to abide by said rules.

MEMBERSHIP AGREEMENT

The undersigned certifies that he/she has explained to the member, in terms that member can understand, the vital importance of following the rules established for members by Energy Martial Arts and agrees to indemnify and save harmless Energy Martial Arts, Redline Athletics, ATA International, its' officers, directors, instructors and agents from any loss, liability, suit or claim arising directly or indirectly from member failing to abide by said rules.

Under this agreement, no further payments shall be due to anyone, including any purchaser of any note associated with or contained in this agreement, in the event that the location at which the contract in entered into ceases operation and fails to offer an alternate location, substantially similar, within ten miles.

Membership Pause:

MEMBERSHIPS CAN BE PAUSED AT ANY TIME FOR A DURATION OF 30 DAYS. MEMBERSHIP PAUSES MUST BE NOTIFIED BY EMAIL AND SHALL BE PROCESSED IMMEDIATELY. MEMBER SHALL NOT HAVE MORE THAN (4) FOUR PAUSES IN A CALENDAR YEAR UNLESS APPROVED BY ENERGY MARTIAL ARTS.

MONTH-TO-MONTH DISCLAIMERS:

MEMBERSHIPS can be paused as shown above or canceled at any time with written notification. Cancellation will be completed as quickly as possible, though it will not constitute a refund if payment has already been submitted, and member can continue with classes through the end of their current billing period.

-Safety Gear Shall be required at camouflage belt.

- The Gear package is $349 +tax and will include the basic gear bag, head gear face shield, mouth piece, hand gear, foot gear, chest protector, combat gloves, combat BME (combat weapon) and the weapon we will be working with the next cycle, either BME or SJB INITIALS

-Each testing cycle may have a weapon and or combat weapon and that weapon must be purchased in order to participate in the section of class dedicated to weapons and that shall be required material for rank testing at the discretion of the instructors. INITIALS:

MONTH-TO-MONTH: The terms of cancellation have been thoroughly explained to me, and I fully understand that these are the only terms of cancellation for this agreement. I must provide 30 days written notice of cancellation by email. If there is a payment scheduled within the 30-day cancellation window, it will be drafted prior to closing the account.
